Fifth - Sixth - Subsequent DUI Offenses
A fifth or subsequent drunk driving offense is a felony under current Wisconsin law. A first offense is non-criminal. A second, third or fourth offense is a misdemeanor. If an accident, injuries or death are caused by a driver proven to be under the influence of alcohol or any other intoxicant, felony charges can be brought against the DUI offender.
Felony Penalties
Prison Sentence
The penalties for a second or subsequent drunk driving offense include mandatory jail time. A fifth or subsequent drunk driving offense includes mandatory prison time for a period of one or more years. Sentencing guidelines suggest a minimum mandatory prison sentence of 5 years. In most instances, the sentence imposed will be in excess of the minimum suggested by those guidelines, unless some other factor can be brought to the judge's attention.
Fines
The sentencing guidelines suggest that fines up to $10,000 also be imposed in addition to a prison sentence for a fifth or subsequent drunk driving offense.
Minor Passengers - Aggravated Charges
If there aggravating circumstances, or if a minor was in the vehicle while the driver was operating that vehicle under the influence, fines can be doubled.
Accident & Injury
An accident with injuries can also result in felony charges.
Death
A vehicular homicide while intoxicated is a felony offense.
