During a free initial consultation
During the initial consultation, the attorney will review your case documentation, and ask you a few (lots) of questions to get as many of the facts as possible. He will then explain the applicable law - Wisconsin law or Federal law - and how that law might apply to your case, and your present and future life. As well, he will discuss his preliminary view of possible defenses that could be raised at trial or in plea negotiations before trial.
An initial consultation is based on facts as your know or believe them to be true. It cannot take into account those facts which the prosecuting attorney may have considered in bringing the charges, or certain police information, evidence, and witness testimony. An initial consultation is limited to the information that you provide. Once you hire an attorney from Birdsall Law Offices, they will immediately demand information, evidence, and facts that won't be available until the demand is made to the prosecuting attorney and a response is received. For example, whether evidence will be used against you will depend on the outcome of a motion to suppress evidence.
Duration of an initial consultation
The criminal defense attorneys at Birdsall Law Office appreciate that your time is limited. They want to be able to at least peruse all of the documentation to gather enough information to be able to give you a very good idea of where you stand. Please try to arrange your consultation for a time when you can spend at least one hour with the attorney.
Initial consultations do not form an attorney-client relationship
An initial consultation will not mean that you are represented. You will not be represented by the attorney until such time that both you and attorney agree to the representation and you hire the attorney.
Hiring an attorney
To hire an attorney, you will need to sign an agreement to be represented, the attorney will accept your signed agreement and provide you with a copy, and you will need to pay the attorney a retainer. Once hired, the attorney will notify the court that he is the "attorney of record".
Calling On Behalf Of Another
In most instances in which one person is calling a law firm on behalf of another person, it is due to the fact that the person who needs the lawyer is in jail, or in some circumstances is a minor (discussed next). If the person is in jail, you can call our firm, you can speak with an attorney about the person in jail, you can share information about the charges and other facts that you know, and in an initial consultation, the attorney can give you information about Wisconsin laws and how those laws might apply to the situation of your friend, spouse or loved one. The attorney can tell you what the arrest record stated, what charges were brought against the person in jail, and who will be prosecuting the case (the prosecuting attorney). All of that information is available under Wisconsin's open records laws.
If you are calling an attorney on behalf of a minor, the attorney cannot discuss all of the facts of the case with you. The rules that apply to privileged information apply to all relationships between an attorney and that attorney's client including minors under the age of 18 years, and even if you are the parent paying for the attorney.
